1. Introduction

M. Vermeulen t/a Viver Fragrância, trading as Segura (“we”, “us”, “our”), is committed to protecting the privacy and personal information of all individuals who interact with our website and services. We are primarily based and operate within the Republic of Namibia, and we also accommodate customers in neighbouring countries on a case-by-case basis.

This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what rights you have in relation to your personal information. It applies to all personal information collected through https://segura.com.na/, our marketing communications, booking systems, WhatsApp community channels, and any other interactions you have with Segura.

This policy is drafted in compliance with the constitutional right to privacy enshrined in Article 13 of the Namibian Constitution, the Consumer Protection Act 5 of 2023 (Namibia), and international best practice. By using our website or services, you acknowledge and accept the practices described in this policy.

2. Information We Collect

We collect the following categories of personal information:

2.1 Information You Provide Directly

  • Full name and contact details (phone number, email address);
  • Delivery and billing address, including country of residence for international customers;
  • Payment information (processed securely via our third-party payment gateways or by EFT — we do not store your card or full banking details directly);
  • Account login credentials (email address and password, stored in encrypted form) where you choose to create an account;
  • Booking information when you schedule an in-store session via our booking system, including preferred date, time, and any notes provided; and
  • Any communications you send us, including support queries, returns requests, WhatsApp messages, or feedback.

2.2 Information Collected Automatically

When you visit our website, we automatically collect certain technical and behavioural information, including:

  • IP address and device type;
  • Browser type and version;
  • Pages visited, time spent on pages, and navigation behaviour;
  • Referring website or source; and
  • Cookie and tracking data (see Section 6 for full details).

2.3 Order & Purchase History

We retain records of your purchases, returns, and interactions with our platform in order to manage your account, fulfil orders, resolve disputes, and improve our services. All prices and transactions are denominated in Namibian Dollars (NAD), including for international customers.

3. How We Use Your Personal Information

We use your personal information only for the purposes for which it was collected, including:

  • Processing and fulfilling your orders, including domestic delivery within Namibia and international shipping arrangements for neighbouring countries on a case-by-case basis;
  • Managing your customer account and login credentials;
  • Processing payments securely through our approved payment gateways and EFT arrangements;
  • Sending you transactional communications such as order confirmations, shipping updates, and invoices;
  • Managing in-store booking appointments and sending related reminders via email and SMS through Brevo Calendar;
  • Communicating updates, promotions, and community content via WhatsApp, where you have voluntarily joined our WhatsApp group or community;
  • Sending marketing emails and SMS messages where you have provided consent or where permitted by applicable law (you may opt out at any time — see Section 7);
  • Improving our website and services through analytics and behavioural data;
  • Resolving disputes, processing returns, and responding to enquiries; and
  • Complying with our legal obligations under Namibian law.

4. Third-Party Service Providers

We share your personal information with trusted third-party service providers only to the extent necessary to operate our business. These include:

4.1 Payment Gateways & EFT

We use DPO Pay (PayFast by Network), PayToday (Namibia), and Electronic Funds Transfer (EFT) to process payments. Payment information is transmitted securely and processed by these providers. We do not store, access, or retain your full card or banking details on our own systems. Where EFT is used, only the minimum banking details required to confirm receipt of payment are retained. Each gateway operates under its own privacy policy and security standards.

We encourage you to review the privacy policies of DPO Pay and PayToday before completing a transaction.

4.2 Analytics – Google Analytics

We use Google Analytics to track and analyse website usage and visitor behaviour. Google Analytics may collect your IP address and browsing behaviour through cookies. This data is anonymised where possible and used solely to improve our website. Google’s data practices are governed by Google’s Privacy Policy (https://policies.google.com/privacy). You may opt out using the Google Analytics Opt-Out Browser Add-on.

4.3 Advertising – Meta (Facebook) Pixel

Our website uses the Meta Pixel to measure the effectiveness of our advertising and serve relevant ads to visitors on Facebook and Instagram. The Meta Pixel may collect information about your browsing behaviour and link it to your Facebook profile where applicable. Meta’s data practices are governed by Meta’s Privacy Policy (https://www.facebook.com/privacy/policy/). You can manage your ad preferences through your Facebook account settings.

4.4 Email & SMS Marketing – Brevo

We use Brevo (formerly Sendinblue) to manage and send our marketing email and SMS campaigns. Your name, email address, and phone number may be stored on Brevo’s servers. Brevo is headquartered in France and operates in compliance with the EU General Data Protection Regulation (GDPR), which provides a high standard of data protection. Your data may be processed on servers outside Namibia. You may unsubscribe from marketing emails at any time via the unsubscribe link in any email, or reply “STOP” to any marketing SMS.

4.5 Booking & Appointment Reminders – Brevo Calendar

We use Brevo Calendar to manage in-store consultation and shopping session bookings. When you book a session, your name, email address, and phone number are used to create and confirm your booking and to send you appointment reminders via email and SMS. This information is processed through Brevo’s platform and is subject to Brevo’s privacy policy. Booking data is retained for the duration of your account and for a reasonable period thereafter to maintain appointment records.

4.6 WhatsApp Group & Community

We maintain a WhatsApp group, and intend to transition to a WhatsApp Community as our customer base grows, to share updates, promotions, new arrivals, and relevant content with our customers. Participation in our WhatsApp group or community is entirely voluntary and consent-based.

Please note the following:

  • We will never add you to any WhatsApp group or community without your explicit consent;
  • By joining our WhatsApp group or community, your phone number and display name will be visible to other members of that group or community;
  • WhatsApp is operated by Meta Platforms, Inc. and is subject to WhatsApp’s own Privacy Policy (https://www.whatsapp.com/legal/privacy-policy). We do not control WhatsApp’s data practices; and
  • You may leave the WhatsApp group or community at any time without penalty.

4.7 Courier & Logistics Providers

To fulfil and deliver your orders, we share your name, delivery address, and contact number with our courier and logistics partners. For domestic orders, this applies within Namibia. For customers in neighbouring countries, delivery arrangements are handled on a case-by-case basis and relevant details will be shared with the applicable logistics provider only.

We do not sell, rent, or trade your personal information to any third party for their own marketing purposes.

5. International Customers

Segura is a Namibian business and our services are primarily offered within Namibia. We do, however, make reasonable efforts to accommodate customers in neighbouring countries on a case-by-case basis. The following conditions apply to international orders:

  • All prices are displayed and charged in Namibian Dollars (NAD). Currency conversion costs and any applicable exchange rate differences are the responsibility of the customer;
  • International shipping arrangements, costs, and timelines will be communicated to the customer prior to dispatch;
  • Any import duties, customs fees, or taxes levied by the destination country are the sole responsibility of the customer; and
  • Personal information of international customers is handled in accordance with this Privacy Policy and processed under the same standards applied to all Segura customers.

By placing an order from outside Namibia, you acknowledge that your personal information will be processed in Namibia and potentially transferred to third-party logistics providers in your region.

6. Data Retention

We retain your personal information for as long as your account remains active with Segura. If you close your account or request deletion of your data, we will action your request subject to the following:

  • We may retain certain information for up to 5 years after account closure where required by Namibian law (e.g. financial records, tax obligations, or dispute resolution);
  • Transactional and order records may be retained for the period required under applicable Namibian tax and commercial law;
  • Booking and appointment records are retained for the duration of your account and for a reasonable administrative period thereafter; and
  • Once the applicable retention period has expired, your personal information will be securely deleted or anonymised.

7. Cookies & Tracking Technologies

Our website uses cookies and similar tracking technologies. A cookie is a small text file placed on your device when you visit our website. We use three categories of cookies:

7.1 Essential Cookies

These cookies are strictly necessary for our website to function. They enable core features such as adding items to your cart, logging into your account, and completing checkout. These cookies cannot be disabled without affecting website functionality.

7.2 Analytics Cookies

We use Google Analytics cookies to collect anonymised information about how visitors use our website. This data helps us understand which pages are most visited and how users navigate our site, enabling us to improve the overall experience. No personally identifiable information is collected through analytics cookies.

7.3 Marketing & Advertising Cookies

We use the Meta Pixel and related marketing cookies to track conversions from our Facebook and Instagram advertisements, and to serve relevant ads to visitors who have previously browsed our website (retargeting). These cookies may link your browsing behaviour to your social media profile.

8. Marketing Communications

With your consent, or where permitted under applicable Namibian law, we may send you marketing communications via the following channels:

  • Email — managed via Brevo;
  • SMS — sent via Brevo; and
  • WhatsApp — only where you have voluntarily joined our WhatsApp group or community.

You may opt out of marketing communications at any time by:

  • Clicking the “Unsubscribe” link at the bottom of any marketing email;
  • Replying “STOP” to any marketing SMS;
  • Leaving the WhatsApp group or community at any time; or
  • Contacting us directly at orders@segura.com.na.

Opting out of marketing communications does not affect transactional communications related to your orders, bookings, account, or returns.

9. Minors & Children’s Privacy

Our website and services are not directed at children under the age of 18, and we do not knowingly collect personal information from minors. We do not target minors through our marketing or product offering. If you believe a minor has provided us with personal information without parental consent, please contact us at orders@segura.com.na and we will promptly delete that information from our records.

10. Your Privacy Rights

In accordance with Namibian constitutional protections and applicable law, you have the right to:

  • Access the personal information we hold about you;
  • Request correction of inaccurate or outdated personal information;
  • Request deletion of your personal information, subject to our legal retention obligations;
  • Withdraw consent for marketing communications at any time;
  • Object to the processing of your personal information where you believe it is being used unlawfully or beyond its stated purpose; and
  • Lodge a complaint with the relevant Namibian authority if you believe your privacy rights have been violated.

11. Data Security

We implement reasonable and appropriate technical and organisational measures to protect your personal information against unauthorised access, disclosure, loss, destruction, or alteration. These measures include:

  • SSL encryption on our website (https://);
  • Encrypted storage of account passwords;
  • Restricted internal access to customer data on a need-to-know basis; and
  • Payment processing exclusively through PCI-DSS compliant third-party gateways.

While we take all reasonable steps to protect your personal information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security and encourage you to use strong, unique passwords for your account.

12. International Data Transfers

Some of our third-party service providers, including Brevo (France) and Google (United States), are based outside of Namibia and may process your personal information on servers located in other countries. Where this occurs, we take reasonable steps to ensure that your data is handled with an equivalent level of protection. Brevo operates in compliance with the EU General Data Protection Regulation (GDPR), and Google operates under its own comprehensive data protection framework. By using our website and services, you consent to your personal information being transferred to and processed in countries outside Namibia where necessary for the provision of our services.

13. Governing Law & Jurisdiction

This Privacy Policy is governed by the laws of the Republic of Namibia. Any disputes arising from or relating to this policy shall be subject to the jurisdiction of the Namibian courts. Nothing in this policy limits or waives any rights you may have under Namibian consumer or privacy law.

14. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy at any time to reflect changes in our business practices, the services we use, or applicable law. The most current version will always be published on our website at https://segura.com.na/. The effective date at the top of this policy will be updated accordingly. We encourage you to review this policy periodically. Continued use of our website or services following any update constitutes your acceptance of the revised policy.
