1. Introduction & Acceptance of Terms

Welcome to Segura, operated by M. Vermeulen t/a Viver Fragrância (“Segura”, “we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of our website at https://segura.com.na/, our physical store, and all associated services, including online purchasing, in-store sessions, and marketing communications.

By visiting our website, creating an account, making a purchase, booking an in-store session, or engaging with our content, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

These Terms must be read together with our Privacy Policy and Refund & Returns Policy, both of which are incorporated by reference and form part of the agreement between you and Segura. In the event of any conflict, these Terms prevail unless otherwise stated.

2. About Segura

Segura is a curated retail brand offering health and wellness products, beauty and skincare, clothing and apparel, fragrances and personal care, and supplements and vitamins. We operate both a physical retail store and an online store, serving customers primarily within Namibia and on a case-by-case basis in neighbouring countries.

All prices displayed on our website are in Namibian Dollars (NAD). We are a Namibian business subject to the laws of the Republic of Namibia, including the Consumer Protection Act 5 of 2023.

3. Eligibility & Use of the Website

By using our website, you confirm that:

  • You are at least 18 years of age, or are accessing the website under the supervision of a parent or legal guardian;
  • You have the legal capacity to enter into a binding agreement;
  • You are not prohibited from using our services under any applicable law; and
  • All information you provide to us is accurate, complete, and up to date.

We do not knowingly provide services to persons under the age of 18 without parental consent. We reserve the right to refuse access to our website or services to anyone at our discretion.

4. Account Registration & Security

4.1 Creating an Account

You may browse our website and make purchases as a guest, or you may create a registered account. A registered account allows you to save wishlists, track orders, and access your purchase history. You are not obligated to create an account to make a purchase.

4.2 Account Responsibilities

If you create an account, you are responsible for:

  • Keeping your login credentials confidential;
  • All activity that occurs under your account, whether or not authorised by you; and
  • Notifying us immediately at orders@segura.com.na if you suspect unauthorised access to your account.

We will never ask for your password via email or phone. You are responsible for ensuring that your account information remains accurate and up to date.

4.3 Wishlists & Saved Items

Registered customers may save products to a wishlist within their account. Wishlists are for personal use only. Saving an item to a wishlist does not reserve stock or guarantee availability or pricing at the time of future purchase. Prices and stock availability are subject to change at any time.

5. Products, Descriptions & Availability

We take care to ensure that product descriptions, images, and specifications on our website are accurate. However, the following conditions apply:

  • Product images are for illustrative purposes only. Colours, textures, and packaging may vary slightly from what is depicted on screen due to display settings and photographic conditions;
  • Some product content, including images and descriptions, is supplied by our brand partners and suppliers. While we endeavour to ensure accuracy, we cannot guarantee that all supplier-provided content is free from error;
  • Product availability is not guaranteed. Items may sell out, be discontinued, or be temporarily unavailable without prior notice;
  • We reserve the right to limit quantities of any product sold; and
  • For supplements, vitamins, and wellness products, product descriptions are not intended as medical advice. Always consult a qualified healthcare professional before use, particularly if you are pregnant, breastfeeding, or taking medication.

6. Pricing, Promotions & Gift Cards

6.1 Pricing

All prices are displayed in Namibian Dollars (NAD) and are inclusive of VAT where applicable. We reserve the right to change prices at any time without prior notice. The price displayed at the time you complete your order will be the price charged, subject to Section 6.3 below.

6.2 Sales & Promotional Discounts

We regularly run sales and promotional discounts. The following conditions apply to all promotions:

  • Promotions are valid for the specified period only and may be withdrawn or amended at any time;
  • Promotional pricing applies only to the items specified and cannot be applied retroactively to previous purchases;
  • Discounts cannot be combined with other offers unless explicitly stated; and
  • We reserve the right to refuse the application of a discount where fraudulent or system errors are involved.

6.3 Pricing Errors

In the event that a product is listed at an incorrect price due to a typographical error or system fault, we reserve the right to cancel any orders placed at the incorrect price, even after an order confirmation has been issued. We will notify you promptly and offer a full refund or the option to purchase at the correct price.

6.4 Gift Cards & Vouchers

Segura gift cards and vouchers are subject to the following conditions:

  • Gift cards are valid for the period stated at the time of issue;
  • Gift cards are non-refundable and cannot be exchanged for cash;
  • Lost, stolen, or damaged gift cards cannot be replaced;
  • Gift cards may not be used to purchase other gift cards; and
  • Any unused balance remaining after the expiry date will be forfeited.

7. Orders & Payment

7.1 Placing an Order

By placing an order on our website, you are making an offer to purchase a product at the stated price. An order confirmation email does not constitute acceptance of your order. Acceptance occurs when we dispatch your order and send you a shipping confirmation, or when you collect your order in-store.

7.2 Payment Methods

We accept payment via the following methods:

  • DPO Pay (PayFast by Network);
  • PayToday (Namibia); and
  • Electronic Funds Transfer (EFT) — EFT orders are processed once proof of payment has been received and payment has been verified. Stock is not reserved until payment is confirmed.

All payments must be made in Namibian Dollars (NAD). For international customers, any currency conversion costs are the responsibility of the customer.

7.3 Order Cancellation & Our Right to Refuse Orders

We reserve the right to cancel or refuse any order at our discretion, including but not limited to where:

  • A product is out of stock or discontinued;
  • A pricing error has occurred;
  • Payment has not been received or verified;
  • We suspect fraudulent activity; or
  • The order cannot be fulfilled due to delivery constraints for international customers.

Where an order is cancelled by us, you will receive a full refund of any amount paid.

8. Delivery & Shipping

8.1 Domestic Delivery (Namibia)

We deliver to addresses within Namibia. Delivery timelines, costs, and methods will be communicated at checkout and in your order confirmation. Delivery timelines are estimates only and are not guaranteed. We are not liable for delays caused by courier services, public holidays, or circumstances beyond our control.

8.2 International Orders (Neighbouring Countries)

We accommodate customers in neighbouring countries on a case-by-case basis. Where we agree to fulfil an international order:

  • Shipping arrangements, costs, and estimated delivery times will be communicated to you prior to dispatch;
  • All prices are in NAD and currency conversion costs are your responsibility;
  • Any import duties, customs fees, or taxes imposed by your country of destination are your sole responsibility; and
  • We cannot guarantee delivery timelines for international shipments and are not liable for delays or losses caused by international courier services or customs processing.

8.3 Risk & Title

Risk in goods passes to you upon delivery to the address provided. Title to goods passes to you upon receipt of full payment.

9. Physical Store & In-Store Sessions

9.1 Physical Store

Segura operates a physical retail store. Prices, product availability, and promotional terms in-store may differ from those displayed on our website. In-store purchases are subject to these Terms where applicable and our separate in-store return conditions.

9.2 Booking In-Store Sessions

Customers may book personalised in-store shopping or consultation sessions through our Brevo Calendar booking system. The following conditions apply:

  • Session bookings are subject to availability;
  • Appointment reminders will be sent via email and SMS to the contact details provided at the time of booking;
  • If you need to cancel or reschedule, please do so at least 24 hours in advance by contacting us at orders@segura.com.na or +264 81 239 3053;
  • We reserve the right to cancel or reschedule sessions and will notify you as soon as reasonably possible; and
  • In-store sessions do not guarantee product availability and do not constitute a reservation of stock.

10. Returns, Refunds & Exchanges

All returns, refunds, and exchanges are governed by our Refund & Returns Policy, which is available on our website at https://segura.com.na/ and is incorporated into these Terms by reference. Your statutory rights under the Consumer Protection Act 5 of 2023 (Namibia) are not affected by these Terms.

11. Intellectual Property & Content Ownership

11.1 Segura-Owned Content

All original content on the Segura website, including but not limited to branding, logos, graphic design, photography, copywriting, and site architecture, is the property of M. Vermeulen t/a Viver Fragrância and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any Segura-owned content without our prior written consent.

11.2 Supplier & Partner Content

Some product images, descriptions, and brand assets are provided by our brand partners and suppliers and remain the intellectual property of those respective parties. Such content is used by Segura under licence or with permission. Unauthorised use of third-party brand assets is prohibited.

11.3 User-Generated Content

When you submit a product review, photograph, comment, or other content to our website (“User Content”), you grant Segura a non-exclusive, royalty-free, perpetual licence to use, display, reproduce, and share that content in connection with our business and marketing activities, including on our website and social media platforms.

By submitting User Content, you confirm that:

  • You own the content or have the right to share it;
  • The content does not infringe any third-party rights; and
  • The content is accurate, honest, and not misleading.

We reserve the right to remove any User Content that we deem inappropriate, offensive, misleading, or in violation of these Terms, without notice.

12. Customer Reviews Policy

We welcome honest and constructive product reviews from verified customers. The following rules apply to all reviews submitted on our platform:

  • Reviews must be based on genuine personal experience with the product;
  • Reviews must not contain offensive, discriminatory, defamatory, or abusive language;
  • Reviews must not include personal information about other individuals;
  • Fake or incentivised reviews (submitted in exchange for payment, discounts, or free products without disclosure) are not permitted; and
  • We reserve the right to moderate, edit, or remove reviews that violate these guidelines.

Where Segura works with influencers or brand ambassadors who receive products or compensation in exchange for content, such content will be disclosed in accordance with applicable advertising standards.

13. Social Media, Influencers & Advertising

13.1 Social Media

Segura maintains active social media accounts linked to our website. Content published on our social media platforms is subject to the terms and community guidelines of each respective platform. We are not responsible for the availability or accuracy of third-party social media platforms.

13.2 Paid Advertising

We run paid advertising campaigns on social media platforms including Facebook and Instagram via Meta. These advertisements may be targeted based on interests, demographics, and website behaviour using the Meta Pixel. You can manage your ad preferences through your social media account settings.

13.3 Influencers & Brand Ambassadors

Segura works with influencers and brand ambassadors who may promote our products and brand. Where such individuals have received products, payment, or other compensation from Segura, their content will include appropriate disclosure (e.g. #ad, #sponsored, #gifted) in accordance with applicable advertising standards. Segura does not control the content or opinions expressed by independent influencers beyond our agreed guidelines.

14. External Links & Partner Brand Websites

Our website contains links to the websites of our partner brands and suppliers. These links are provided for your convenience and information only. Segura does not endorse, control, or take responsibility for the content, privacy practices, or availability of any external website. Your use of any linked website is at your own risk and subject to the terms and conditions of that website.

The presence of a link to an external website does not imply a partnership, endorsement, or affiliation beyond what is explicitly stated on our website.

15. Prohibited Conduct

When using our website or services, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorised access to any part of the website, server, or database;
  • Transmit any harmful, malicious, or disruptive code, including viruses or malware;
  • Scrape, harvest, or collect data from the website without our prior written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Post or transmit any content that is offensive, defamatory, discriminatory, or in violation of any third-party rights;

  • Engage in any fraudulent activity, including placing false orders or submitting fake reviews.

Any breach of this section may result in the immediate suspension or termination of your account and, where applicable, referral to the relevant authorities.

16. Our Reserved Rights

Segura expressly reserves the following rights, which may be exercised at our sole discretion:

  • To suspend, restrict, or permanently terminate any customer account where we have reason to believe it has been used in violation of these Terms, fraudulently, abusively, or in a manner inconsistent with our brand values;
  • To cancel or refuse any order, whether before or after confirmation, for reasons including but not limited to pricing errors, stock unavailability, suspected fraud, or inability to fulfil delivery requirements;
  • To amend prices on our website at any time without prior notice, subject to Section 6.1; and
  • To modify, suspend, or discontinue any feature, product, service, or promotion at any time without liability.

Where an action taken under this section results in financial loss to you, our liability is limited to a refund of any amount you have paid for an unfulfilled order.

17. Disclaimer & Limitation of Liability

17.1 Website Availability

We strive to ensure that our website is available at all times. However, we do not guarantee uninterrupted or error-free access. We may take the website offline for maintenance, updates, or due to circumstances beyond our control, without notice and without liability.

17.2 Product Information

Whilst we take care to ensure that product information is accurate, we do not warrant that all descriptions, images, or specifications are free from error. For regulated products such as supplements and wellness items, information on our website does not constitute medical advice. Always consult a qualified healthcare professional.

17.3 Limitation of Liability

To the maximum extent permitted by Namibian law, Segura shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our website or services, including loss of data, loss of revenue, or damage to reputation.

Nothing in these Terms excludes or limits liability that cannot be excluded under the Consumer Protection Act 5 of 2023 or any other applicable Namibian law.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Namibian courts.

In the event of a dispute, we encourage you to contact us first at orders@segura.com.na to resolve the matter informally. If we are unable to reach a resolution, you may approach the relevant consumer protection authority or the appropriate Namibian court.

19. Changes to These Terms

We reserve the right to update or amend these Terms at any time. The revised Terms will be published on our website with an updated effective date. Where changes are material, we will endeavour to notify registered customers via email. Your continued use of our website or services after any update constitutes your acceptance of the revised Terms.
